These are some of the factors we weigh when determining alimony:

  • The difference in the divorcing parties’ incomes
  • The duration of the marriage
  • The employability, educational levels, earning capacities, and vocational skills of each of the parties
  • How old the parties are, along with their physical health and emotional health
  • How much it would cost and how long it would take to obtain enough education to allow a party to secure appropriate employment
  • Each party’s history of financial (or non-financial) contributions to the marriage
  • How much each party is contributing to the children’s care and education
  • The Equitable distribution of property that has been agreed upon, as well as the payouts
  • The standard of living that was established in the marriage, and how likely it is that each party will be able to maintain that standard of living (or a reasonably comparable one)
  • How long the requesting party has been away from the job market
  • The tax consequences (to both parties) of any proposed alimony
  • Anything else relevant to alimony.

These factors are considered when determining how much alimony and how long it will be paid or received.
