Here’s a question that people ask me as a New Jersey Divorce Lawyer, and it’s a good one. “Can we share a home during the divorce?” The answer is absolutely yes. Oftentimes, there’s a situation in which one spouse is earning money and paying for the home for you, your children, et cetera. If the spouses were forced to separate, they would need two sources of income to support themselves. It can actually work out better for both sides if they can live together in their residence as they go through the divorce.

These issues are very fact-specific. Sometimes, because of domestic violence or some other reason, you simply cannot live with your spouse during the divorce. You have to look for alternate solutions. This has to be thought through and decided when you first meet with your attorney.
