Should I Get a Collaborative Divorce?

There’s something called collaborative divorce and people ask me, “Why don’t I do a collaborative divorce? Why wouldn’t everybody use collaborative divorce?” Basically, collaborative divorce is a type of mediation. It means you’re going to work with each other and try to resolve your issues amicably – without the assistance of a judge. What that really means is that you sign a piece of paper that says, “I’m not going to file a complaint for divorce. I’m going to work through the process on my own time with my spouse and we’ll try to figure it out.” It is generally a very good process, and it can work.

The problem is that, by its very nature, the divorce process is antagonistic and adversarial. You’ve got to be tough, smart, and experienced. You have to understand that some issues will not be resolvable. No matter what you say, and no matter what you do, you’re going to need a human being in a black robe to sit as a judge and look at you and your spouse and say, “Okay. You, sir, are wrong. You, madam, are wrong. You, sir, are right. You, madam, are right.” Somewhere, somehow, the judge is going to figure this out. The collaborative divorce process is a great option if you are, at some level, amicable with your spouse. Go for it. Try it. Try to get it done. In the end, anything that can keep you out of the process of divorce is going to be helpful to you and your family.
