If it’s 20 or less, your alimony will not last longer than the term of your marriage. For example, if you were married for 12 years, except in the case of exceptional circumstances, you will get alimony for up to 12 years. Likewise, if you were married for four years, your alimony will extend past four years only if there are exceptional circumstances. When considering how long you’ll receive alimony, that time constraint is the main premise.
The second consideration is financial – the income, ability to pay, and needs of the individuals. For example, in a short-term marriage, the need may only last for a short time. Figure it out. How much money do you need? How long will it be necessary to support the individual as they get back on their feet? The concept of alimony is based on the lifestyle of the marriage. First and foremost, the length of the marriage is the determinant factor.
The other big factor in setting the amount of alimony is need. Look at the number of years of the marriage, compare the incomes of both parties, and add up their assets and debts. There’s your basic premise. That’s where you’re going to start. Yes, that’s a big blend of several separate elements. That’s when you need an experienced alimony attorney who can say, ”Listen. You’ve been married for 12 years, so no matter what, you won’t be getting alimony for 15. It doesn’t work that way. Here’s what the law says.”
